Moves by Prof Zana Akpagu, one of the aspirants for the Cross River Northern Senatorial District election under the umbrella of the APC to secure an exparte injunction from the Federal High Court, Port Harcourt has collapsed.
The trial judge, Mr Justice Hillary Oshioma of Court 4 refused to grant Akpagu’s request and transferred the matter to the Federal High Court, Calabar.
Akpagu who approached the court for an exparte order restraining Mr Joe Agi, SAN, from carrying on as the APC flagbearer for the election was disappointed when the judge said the request could not be granted.
His lawyer, Chief Abiye Atorudibo had battled to convince the court without success.
He had, in his application, agreed that the APC had already submitted Agi’s name as its candidate for the election. But he wanted a restraining order from the court to stop Agi’s candidacy.

The judge, in questioning his prayers said he could not stop Agi or the party, since the name of the Senior Advocate of Nigeria had already been submitted to INEC.
The judge had also questioned the documents filed before it by the lawyer. He did not mark some of them properly.
