Out of Court Settlement Initiative Fails in Royal Fathers’ Suit Against A’Ibom Govt

Parties involved in the case involving the Akwa Ibom State government and some traditional rulers from the state will return to the state high court on November 16 for continuation of hearing on the substantive suit.

 

The royal fathers from Annang, Ekid and Oro Nations dragged the governor to court to challenge the newly amended traditional rulers council law of the state. Their grouse is that the law places them in perpetual position of subordination to the Ibibio ruler.

 

When the case came up on Monday, the royal fathers, through their counsel, Jumbo Uyo-Obong Udom had sought a leave of the court to explore an out of court settlement and for the case to be adjourned sine die.

 

But the state attorney-general, Uko Essien Udom, SAN, insisted that the royal fathers must withdraw the case outrightly, otherwise, the case should proceed and be taken to the end.

 

The judge, Mr Justice Archibong Archibong had urged the attorney-general to take some days to consider his position on the motion for temporal withdrawal of the suit as suggested by the plaintiff, but Udom told the court that he did not need more time to take a decision.

 

It was at that time that the judge ruled, that the matter had to proceed and adjourned the case to November 16.
